Data Use and Model Improvement Policy

Prebreak Inc., a Delaware corporation
700 E Redlands Blvd U172, Redlands, CA 92373

Effective date:

This policy forms part of the Platform Terms or another agreement expressly incorporating it. It governs customer project materials and related service information used to improve Prebreak. A stricter signed agreement, processing restriction, source license, legal duty or recorded opt-out controls a conflict. A privacy notice alone does not grant intellectual-property rights or replace required consent.

Ownership, license, and improvement purposes

Customers retain ownership of their project materials and private house knowledge, subject to third-party rights. Under the governing agreement, Customer grants Prebreak a non-exclusive, worldwide, royalty-free license to access, reproduce, host, process, transform, analyze, annotate, derive from and use eligible materials and service information for the purposes and periods stated here. Authorized employees, reviewers and contracted providers may perform these activities on Prebreak’s behalf under purpose, confidentiality, security and onward-use restrictions.

Eligible project data contributes to improvement by default unless Customer opts out or a stricter restriction applies. Uses include developing, training, fine-tuning, testing, evaluating, calibrating, correcting and improving Prebreak-controlled models, algorithms, software, plan mappings, extraction, requirements, legal-rule implementation, reusable knowledge, forecasts, financial methods, recommendations and user experience. Improvements may be commercialized across Prebreak’s products and benefit other customers. Participation does not create royalties, attribution rights, product ownership or preferential access.

This permission does not give other customers access to private source files or identifiable confidential details. Independent providers may not train their unrelated or general-purpose models on private customer records. They may perform authorized Prebreak-controlled training on its behalf under the same restrictions. The license does not authorize selling raw private customer materials as a dataset.

What may contribute

Subject to eligibility, inputs may include files and extracted content; plans and revisions; requirements and evidence relationships; jurisdiction practices; applications and correction histories; prompts/responses; accepted, rejected and corrected outputs; professional and agency interactions; workflow sequences and features used; package/review history; and actual timing, yield, cost and outcome information.

Preparation may include minimization, de-identification, annotation and qualified review. Learning from a private record does not authorize treating it as binding law, publishing a confidential comparable or placing it in another customer’s retrieval results. Released rules and observed claims remain subject to source authority, coverage, review and export controls.

Eligibility and exclusions

Default inclusion applies only where Customer has sufficient rights, the use is lawful, and agreements and preferences permit it. An uploader cannot license another person’s work or waive that person’s privacy rights without authority. Prebreak applies the more restrictive applicable rule. Unresolved eligibility holds material out of optional improvement until resolved.

Credentials, access tokens, payment information, government identifiers, children’s information, specially regulated or sensitive personal information, privileged/counsel-restricted communications, sealed records, and material subject to incompatible licenses or confidentiality obligations are excluded from default shared training. A specific exception requires valid rights, required consent, documented controls and any necessary separate agreement. The ordinary default setting is insufficient. Missing labels do not create absent rights.

Nonpersonal confidential project material can contribute where Customer’s license and confidentiality obligations permit. For personal information processed as a service provider or processor, internal improvement remains limited by applicable law and the processing agreement. Prebreak does not use that label to authorize unrestricted combining of identifiable customer records or use for other customers. Shared learning uses eligible nonpersonal or properly de-identified information and rights-cleared materials; any independently controlled personal-information use requires its own lawful basis and disclosures before it starts.

Deleting names or substituting IDs is not necessarily de-identification. Addresses, parcel/case numbers, rare plans and combinations of facts may identify people or reveal confidential information. Where relying on de-identified data, Prebreak takes reasonable measures to prevent association with a person or household, maintains and uses it in de-identified form, and contractually restricts recipients accordingly. It does not attempt re-identification except to test de-identification where law permits. Confidentiality review remains separate from the personal-information test.

Opt-out controls and effect

An authorized organization administrator may disable optional improvement in Settings > Data Controls > Improve Prebreak. An authorized project administrator may also exclude a project. Organization Off controls all its projects; project Off controls that project even when the organization is On. New projects inherit organization state. If the setting is unavailable or inaccessible, an authorized customer representative may email hello@prebreak.com with “Data Controls”; Prebreak will verify authority, confirm scope and record the request.

The exclusion takes effect when the setting change or verified request is recorded. Prebreak thereafter excludes affected source materials, attributable usage and derivatives, and staged examples from new optional improvement selection, training and evaluation. Copying material into a queue before opt-out does not authorize a later new run. For a run already in progress, Prebreak will prevent release of an improvement containing the newly excluded contribution unless it can lawfully remove that contribution or another valid basis permits it.

Opt-out does not disable processing necessary to deliver Customer’s own project service, security, billing, legal compliance or requested support. Optional shared training may not be disguised as essential telemetry. Core service remains available without a separate opt-out fee under these terms. Individual privacy rights and legally required withdrawals operate independently of organization settings.

Previous learning, deletion, and retention

Opt-out stops the new optional uses described above; deletion follows law, instructions and the retention schedule. Prebreak removes or restricts attributable staged improvement records and propagates relevant exclusions to derived datasets, indexes, embeddings, caches and instructed providers. A legal hold, security or backup retention duty does not make records eligible for optional training.

To the extent lawful, Prebreak may retain and use generalized statistics, improvements, model parameters, rules and knowledge already incorporated before exclusion took effect, provided continued retention/use does not disclose customer confidential information or violate personal-information law or contract. This surviving right does not authorize keeping raw opted-out files for future training, keeping customer-specific retrievable embeddings as “generalized learning,” or ignoring a model’s reproduction of protected information.

Prebreak does not promise that opting out automatically retrains every existing model or removes every statistical influence. Any legally or contractually required deletion or remediation controls, including assessment of affected derivatives or models. Leakage or memorization reports are assessed through privacy, security and model-correction procedures; affected use may require restriction, removal or retraining.

Improvement source records follow documented useful-life criteria: authorized purpose, continuing necessity, current settings, source rights, risk and legal duties. Lawfully de-identified generalized improvements may remain for continuing product use within the restrictions above. Indefinite retention of all identifiable training records is not authorized.

Existing commitments and changes

Legacy material covered by an earlier no-training promise, restrictive NDA, source license or opt-out is not enrolled merely by posting a new policy, continuing ordinary service use or making an unrelated upload. Prebreak must obtain any necessary amendment, informed authorization or consent before reusing it. Customer cannot grant rights it lacks in other people’s data or work.

Material changes are prospective with appropriate notice and required acceptance or consent. Settings do not silently reset to On. A successor receives only the rights Prebreak lawfully holds and remains subject to surviving privacy, confidentiality and opt-out restrictions.
