Copyright and DMCA Policy

Prebreak Inc., a Delaware corporation
700 E Redlands Blvd U172, Redlands, CA 92373

Effective date:

Prebreak respects intellectual-property rights. This policy describes copyright complaints concerning material hosted by Prebreak, including customer-uploaded material where the relevant service permits it. Material need not be publicly visible to raise a copyright issue. A complaint about material solely on an independent third-party site should also be directed to that site’s operator.

Designated agent

Send copyright notices and counter-notices to:

Agent name, title, or organization: [CONFIRM REGISTERED DESIGNATED AGENT]

Service provider: Prebreak Inc.

Agent mailing address: [CONFIRM AGENT MAILING ADDRESS]

Agent telephone: [INSERT AGENT TELEPHONE]

Agent email: [CONFIRM REGISTERED AGENT EMAIL]

For general copyright questions, contact hello@prebreak.com with “Copyright” in the subject. General correspondence is distinct from a compliant statutory notice. The designated-agent details above must match the active U.S. Copyright Office registration when this DMCA procedure is published.

Copyright notices

If you own a copyright or are authorized to act for its owner, provide a written notice containing:

Your physical or electronic signature.

Identification of the copyrighted work, or a representative list if the notice concerns multiple works at one online site.

Identification and location of the allegedly infringing material sufficient for us to find it. Include a URL or, for restricted material, the available project, document, version, or other reference; you do not need to circumvent access controls.

Your address, telephone number, and an email address at which you can be contacted.

A statement that you believe in good faith that the challenged use lacks authorization from the copyright owner, the owner’s agent, or applicable law.

A statement that the notice’s information is accurate and, under penalty of perjury, that you are authorized to act for the owner of the exclusive right involved.

Consider applicable permissions and legal exceptions, including fair use, before submitting a notice. Do not include unrelated confidential information or copies of identity documents.

Response and counter-notices

We will assess notices, seek missing information where appropriate, and expeditiously remove or disable access when required by the applicable DMCA process. We will take reasonable steps to notify the submitting user. We may provide the notice and contact details to that user, an affected customer administrator, and advisers as needed to handle the claim or comply with law.

If you believe your material was removed or disabled because of mistake or misidentification, send the designated agent a written counter-notice containing:

Your physical or electronic signature.

Identification of the removed or disabled material and its location before the action.

A statement under penalty of perjury that you believe in good faith that the removal or disabling resulted from mistake or misidentification.

Your name, address, and telephone number.

Your consent to the jurisdiction of the U.S. federal district court for the district where your address is located, or, if outside the United States, a district where Prebreak may be found; and your agreement to accept service of process from the original notifying person or that person’s agent.

We will provide a qualifying counter-notice to the original notifying person. Under the applicable statutory process, we will restore access no earlier than 10 and no later than 14 business days after receipt, unless the designated agent first receives notice of an action seeking a court order restraining the alleged infringement. Separate lawful grounds for restricting material may still apply; we will identify them where appropriate.

Repeat infringement and records

We maintain a policy of terminating the accounts of repeat infringers in appropriate circumstances and accommodate applicable standard technical measures under the DMCA. Restricted or removed content may be preserved as necessary for legal obligations, disputes, or legal holds, with access appropriately limited. An immutable project record does not prevent lawful restriction of access to infringing material.

Misrepresentation

Knowingly making a material misrepresentation in a notice or counter-notice can result in liability under 17 U.S.C. § 512(f), including qualifying damages, costs, and attorneys’ fees. This procedure addresses copyright; other disputes may be reported to hello@prebreak.com.
